Dear USCF,
This letter accompanies a tournament
rating report for the 45th GEM CITY OPEN played April 25-27,
2003.
In that report you will find 150 games to be rated. It
is this director’s opinion one of the games should not be rated as it was not
truly a game.
This is the game between GM Wojtkiewicz
(white) and GM Kreiman (black) in round 5. It went as
follows.

The Official
Rules of Chess within rule 14.b.6 states, “It is unethical and unsporting
to agree to a draw before a serious contest has begun.” Clearly this draw
was agreed to before a serious contest had begun.
As a result of
rule 14.b.6 I would like your assurances the above game will not be
rated.
